Hearing on Georgia's 1332 State Innovation Waiver Scheduled for Wednesday, June 1, 2022

Pursuant to 31 CFR 33.112(c) and 45 CFR 155.1312(c), notice is hereby given that the State of Georgia Office of Commissioner of Insurance and Safety Fire (OCI) will conduct a Public Forum and accept public comments on the progress of Georgia’s Section 1332 Waiver implementation.

Background Summary


On March 27, 2019, Governor Brian P. Kemp signed Senate Bill 106, The Patients First Act, authorizing the Governor to submit a Section 1332 Waiver application to the Department of Health & Human Services and Department of the Treasury to pursue and implement innovative solutions to address healthcare challenges in the State.

On November 1, 2020, the State of Georgia received approval for its Section 1332 Waiver to implement a two-part approach to address the healthcare access and affordability challenges facing many residents across the State. Part I of the waiver is a five-year reinsurance program that began in Plan Year (PY) 2022 and is in effect through PY 2026. Part II of the waiver transitions the State’s individual market from the Federally-facilitated Exchange (FFE) to Georgia Access for Open Enrollment (OE) for PY 2023 through PY 2026.

Pursuant to the Specific Terms and Conditions (“STCs”) applicable to the 1332 Waiver and 31 CFR §33.112(c) and 45 CFR §155.1312(c), the State is required to host an annual Post-Award Public Forum to accept public comment on the progress of the Section 1332 Waiver’s implementation. Public Forum Information

OCI will hold a Public Forum in-person and also provide remote conferencing capabilities to accept public comments on the progress of Georgia’s Section 1332 Waiver. The public is invited to join in-person at the location below or dial-in remotely using the zoom meeting link, to be provided at https://oci.georgia.gov/ at 9:30 am June 1, 2022. Oral presentations at the hearing may be limited to five (5) minutes per person in order to afford all interested persons an opportunity to be heard.
