NOTICE OF INTENT TO ADOPT RULE CHANGES AND NOTICE OF HEARING
Notice is hereby given pursuant to the Georgia Administrative Procedure Act, Code Sections 50-13-3, 50-13-4, 50-13-6, 50-13-21, and 33-2-9 of the following proposals by the Commissioner of Insurance to amend the Rules and Regulations of the Office of the Commissioner of Insurance.
The Rules and Regulations of the Office of the Commissioner of Insurance are proposed to be amended by the following actions:
- By amending Rule 120-2-3-.09 to remove provisions pertaining to Universal Claims Certification.
- By amending Rule 120-2-3-.12 to enable education providers to use advanced technology for online courses.
- By amending Rule 120-2-3-.19 to remove provisions pertaining to Universal Claims Certification.
- By amending Rule 120-2-3-.21 to remove provisions pertaining to Universal Claims Certification.
- By promulgating Rule 120-2-23-.24 to establish group capital calculation requirements for compliance with accreditation standards of the National Association of Insurance Commissioners.
- By amending Rule 120-2-49-.11 to move annual renewals for Third Party Administrators from March to August.
- By amending Rule 120-2-72-.05 to provide for minimum amounts of tax assessed for the special fraud assessment fund and clarify assessment amounts and procedures; this changes minimum amounts of fund contributions for small businesses.
- By amending Rule 120-2-106-.10 to update arbitration requirements for consistency with 2023 GA. HB 295. This changes the review period from 30 days to 60 days consistent with the requirements of O.C.G.A. § 33-20E-9 as amended in 2023.
- By amending Rule 120-2-111-.01 to clarify certification requirements for Independent Review Organizations. This clarifies Department determination of automatic certification upon receipt of certain required items.
- By amending Rule 120-2-111-.02 to clarify definitions pertaining to Independent Review Organizations. This cleans up syntax with respect to the definitions currently in place.
- By amending Rule 120-2-111-.03 to clarify certification requirements for Independent Review Organizations. This clarifies Department determination of automatic certification upon receipt of certain required items.
- By amending Rule 120-2-111-.14 to provide for rejection of duplicate requests for Independent Review. This enables the Department to reject duplicate requests that have already been independently reviewed by an Independent Review Organization.

The aforesaid proposals are now on file in the Administrative Procedure Division of the Office of Commissioner of Insurance, 708 West Tower, Floyd Building, Two Martin Luther King, Jr. Drive, Atlanta, Georgia 30334, and are hereby declared to be a public record as follows:
Interested persons may participate in the proposed rulemaking process by submitting their written comments to Jeremy Betts, Administrative Procedure Division, Office of Commissioner of Insurance, 708 West Tower, Floyd Building, Two Martin Luther King, Jr. Drive, Atlanta, Georgia 30334. All comments must be received by the Administrative Procedure Division by 4:30 P.M. on May 28th, 2025.
Interested persons may also participate in the proposed rulemaking by submitting oral comments at the hearing to commence on June 4, 2025, at 1:00 p.m. in the Hearing Room of the Office of Commissioner of Insurance, Ninth Floor, West Tower, Floyd Building, Two Martin Luther King, Jr. Drive, Atlanta, Georgia 30334.
Oral presentations at the hearing may be limited to five (5) minutes per person in order to afford all interested persons an opportunity to be heard. Based upon full consideration of all written and oral comments regarding the above matters, the Commissioner of Insurance may reject or adopt the proposed rules or may make changes to the proposed rules which may require another rulemaking hearing.
