Hearing on New Rules and Regulations Scheduled for December 3, 2025
Notice is hereby given pursuant to the Georgia Administrative Procedure Act, Code Sections 50-13-3, 50-13-4, 50-13-6, 50-13-21, and 33-2-9 of the following proposals by the Commissioner of Insurance to amend the Rules and Regulations of the Office of the Commissioner of Insurance.
The Rules and Regulations of the Office of the Commissioner of Insurance are proposed to be amended by the following actions:
- Promulgating Rule 120-2-14-.01 relating to Authority to provide for the statutory authority of the Commissioner to promulgate Rules and Regulations relating to the Automobile Insurance Plan under O.C.G.A. §§ 33-2-9 and 40-9-100.
- Promulgating Rule 120-2-14-.02 relating to Purpose to provide for the function of this subject relating to the Automobile Insurance Plan.
- Promulgating Rule 120-2-14-.03 relating to Definitions to provide for definitions pertaining to Applicant, Automobile, Commissioner, Committee, Individual, Person, Plan, Subscriber, and User of the Plan.
- Promulgating Rule 120-2-14-.06 relating to Plan Composition to provide for the criteria the Committee shall include in the Automobile Insurance Plan.
- Promulgating Rule 120-2-14-.09 relating to Filing of Rates, Rating Systems, Rating Plans, Underwriting Rules and Policy Forms to provide for various criteria for insurers relating to the Automobile Insurance Plan.
- Promulgating Rule 120-2-14-.10 relating to Statistical Agent to provide for the authority of statistical agents in collecting and maintaining the relevant information necessary to formulate assignments and rates.
- Promulgating Rule 120-2-14-.11 relating to Insurers Required to Provide Statistics, Data and Information to Statistical Agent to provide for the requirements of insurers in furnishing statistical agents with all necessary information.
- Promulgating Rule 120-2-14-.12 relating to Hearing to provide for the procedure for any person seeking a hearing related to this subject.
- Promulgating Rule 120-2-14-.15 relating to Penalties to provide for the consequences of failing to comply with this subject.
- Promulgating Rule 120-2-14-.16 relating to Severability to provide for the possibility of any provision in this subject being found invalid by a court of competent jurisdiction.
- Promulgating Rule 120-2-113-.01 relating to Statutory Authority to promulgate this subject in accordance with O.C.G.A. § 33-46-20.1 and the passage and signing of 2025 Senate Bill 5.
- Promulgating Rule 120-2-113-.02 relating to Purpose to provide for the function of this subject relating to the Gold Card Program.
- Promulgating Rule 120-2-113-.03 relating to Definitions to provide for definitions pertaining to Health insurer or insurer, Program, and all other terms as defined in Chapter 46 of Title 33.
- Promulgating Rule 120-2-113-.04 relating to Reporting Requirements to provide for the timing and content of each filing to the Commissioner relating to prior authorization requirements.
- Promulgating Rule 120-2-113-.05 relating to Penalties to provide for the consequences of failing to comply with this subject.
- Promulgating Rule 120-2-113-.06 relating to Severability to provide for the possibility of any provision in this subject being found invalid by a court of competent jurisdiction.
SCHEDULE
The aforesaid proposals are now on file in the Administrative Procedure Division of the Office of Commissioner of Insurance, 708 West Tower, Floyd Building, Two Martin Luther King, Jr. Drive, Atlanta, Georgia 30334, and are hereby declared to be a public record as follows:
Interested persons may participate in the proposed rulemaking process by submitting their written comments to Jeremy Betts, Administrative Procedure Division, Office of Commissioner of Insurance, 708 West Tower, Floyd Building, Two Martin Luther King, Jr. Drive, Atlanta, Georgia 30334. All comments must be received by the Administrative Procedure Division by 4:30 P.M. on November 26th, 2025.
Interested persons may also participate in the proposed rulemaking by submitting oral comments at the hearing to commence on December 3rd, 2025, at 10:00 a.m. in the Hearing Room of the Office of Commissioner of Insurance, Ninth Floor, West Tower, Floyd Building, Two Martin Luther King, Jr. Drive, Atlanta, Georgia 30334.
Oral presentations at the hearing may be limited to five (5) minutes per person in order to afford all interested persons an opportunity to be heard. Based upon full consideration of all written and oral comments regarding the above matters, the Commissioner of Insurance may reject or adopt the proposed rules or may make changes to the proposed rules which may require another rulemaking hearing.
