Notice is hereby given pursuant to the Georgia Administrative Procedure Act, Code Sections 50-13-3, 50-13-4, 50-13-6, 50-13-21, and 33-2-9 of the following proposals by the Commissioner of Insurance to amend the Rules and Regulations of the Office of the Commissioner of Insurance.

The Rules and Regulations of the Office of the Commissioner of Insurance are proposed to be amended by the following actions:       

  1. Amending Rule 120-2-3-.05 relating to Licensure of Agencies to provide for the elimination of requirements for branch offices of agencies and to provide for other matters amended by the passage and singing of 2025 House Bill 410.
     
  2. Amending Rule 120-2-3-.48 relating to Navigator and Georgia Access Specialist to provide for Georgia Access Specialist certification by the Georgia Access Division of the Office of Commissioner of Insurance and Safety Fire and to remove the reference to Sircon for registration.
     
  3. Amending Rule 120-2-112-.03 relating to Definitions to provide for definitions pertaining to APTC, Catastrophic Health Plans, DE, Dependents, EDE, Full Time Employees, the Policy Manual, Special Enrollment Periods, Triggering Events; to clarify other definitions and alter syntax.
     
  4. Amending Rule 120-2-112-.04 to provide for clarification that such Rule is applicable to QHP and SADPs.
     
  5. Amending Rule 120-2-112-.06 relating to Enrollment Periods to provide for Special Enrollment Periods consistent with 45 C.F.R. § 155.420.
     
  6. Promulgating Rule 120-2-112-.09 relating to Small Business Health Options Program to provide for the Small Business Health Options Program.
     
  7. Promulgating Rule 120-2-112-.10 relating to Consumer Application and Annual Renewals to provide for requirements for consumer applications and automatic plan renewals.
     
  8. Promulgating Rule 120-2-112-.11 relating to Consumer Eligibility for Qualifying Health Plans and Financial Assistance to provide for requirements for eligibility for qualifying health plans and financial assistance.
     
  9. Promulgating Rule 120-2-112-.12 relating to Right to Appeal Eligibility Determination to provide for the manner and procedure of consumer appeals for adverse determinations for enrollment in QHPs or SADPs and determinations of eligibility for APTC or CSR in conformity with O.C.G.A. § 33-2-17 and Subject 120-2-2 of this Regulation Chapter.
     
  10. Promulgating Rule 120-2-112-.12 relating to Termination of Coverage to provide for issuer termination of coverage of QHPs and SADPs.

The aforesaid proposals are now on file in the Administrative Procedure Division of the Office of Commissioner of Insurance, 708 West Tower, Floyd Building, Two Martin Luther King, Jr. Drive, Atlanta, Georgia 30334, and are hereby declared to be a public record as follows:

Interested persons may participate in the proposed rulemaking process by submitting their written comments to Jeremy Betts, Administrative Procedure Division, Office of Commissioner of Insurance, 708 West Tower, Floyd Building, Two Martin Luther King, Jr. Drive, Atlanta, Georgia 30334. All comments must be received by the Administrative Procedure Division by 4:30 P.M. on September 3rd, 2025. 

Interested persons may also participate in the proposed rulemaking by submitting oral comments at the hearing to commence on September 10th, 2025, at 10:00 a.m. in the Hearing Room of the Office of Commissioner of Insurance, Ninth Floor, West Tower, Floyd Building, Two Martin Luther King, Jr. Drive, Atlanta, Georgia 30334.     

Oral presentations at the hearing may be limited to five (5) minutes per person in order to afford all interested persons an opportunity to be heard. Based upon full consideration of all written and oral comments regarding the above matters, the Commissioner of Insurance may reject or adopt the proposed rules or may make changes to the proposed rules which may require another rulemaking hearing.
