NOTICE OF INTENT TO ADOPT RULE CHANGES AND NOTICE OF HEARING

Notice is hereby given, pursuant to the Georgia Administrative Procedure Act, O.C.G.A. Sections 50-13-3, 50-13-4, 50-13-6, 50-13-21, and 33-2-9 of the following proposals by the Commissioner of Insurance to amend the Rules and Regulations of the Office of the Commissioner of Insurance.

The Rules and Regulations of the Office of the Commissioner of Insurance are proposed to be amended by the following actions:

  • By Amending Chapter 120-2-3-.48 entitled “Navigator and Georgia Access Specialist”
  • By Amending Chapter 120-2-4 to be entitled “Off-Duty Employment”
  • By Amending Chapter 120-2-4-.01 to be entitled "Definitions"
  • By Amending Chapter 120-2-4-.02 to be entitled “Approval”
  • By Amending Chapter 120-2-4-.03 to be entitled “Eligibility”
  • By Amending Chapter 120-2-4-.04 to be entitled “General Provisions”
  • By Amending Chapter 120-2-4-.05 to be entitled “Unacceptable Employment”
  • By Amending Chapter 120-2-4-.06 to be entitled “Off-Duty Employer Responsibilities”
  • By Creating Chapter 120-2-112 to be entitled “Georgia Access”

SYNOPSIS AND EXPLANATION OF PROPOSED RULE CHANGES

The primary purpose of the proposed changes to all Regulation Chapters noted above is to modernize and modify the regulations, increase departmental efficiency in delivering services, and bring them into conformity with industry best practices to the benefit of Georgia Consumers.

The main purpose of these amendments to 120-2-3-.48 are to clarify differences between the Navigator and Georgia Access Specialist programs.

The main purpose of these amendments to 120-2-4 is to establish the rules for the use of official vehicles for off-duty employment of agents of the Insurance Commissioner.

The main purpose of the amendment to 120-2-4-.01 is to establish definitions related to off-duty police employment.

The main purpose of the amendments to 120-2-4-.02 is to establish a procedure for the approval of off-duty police employment.

The main purpose of the amendments to 120-2-4-.03 is to establish rules for the eligibility for approval of off-duty police employment.

The main purpose of the amendments to 120-2-4-.04 is to establish rules pertaining to off-duty police employment generally.

The main purpose of the amendments to 120-2-4-.05 is to establish rules pertaining to types of jobs that may be disapproved for off-duty police employment.

The main purpose of the amendments to 120-2-4-.06 is to establish rules pertaining to indemnity by off-duty employers and to clarify the scope of employment generally.

The main purpose of the creation of 120-2-112 rule is to establish a new chapter of regulations pertaining to Georgia’s State Based Exchange.

SCHEDULE

The aforesaid proposals are now on file in the Administrative Procedure Division of the Office of Commissioner of Insurance, 708 West Tower, Floyd Building, Two Martin Luther King, Jr. Drive, Atlanta, Georgia 30334, and are hereby declared to be a public record as follows:

Interested persons may participate in the proposed rulemaking process by submitting their written comments to Jeremy Betts, Administrative Procedure Division, Office of Commissioner of Insurance, 708 West Tower, Floyd Building, Two Martin Luther King, Jr. Drive, Atlanta, Georgia 30334. All comments must be received by the Administrative Procedure Division by 4:30 P.M. on June 19, 2024.

Interested persons may also participate in the proposed rulemaking by submitting oral comments at the hearing to commence on June 26, 2024 at 9:00 a.m. in the Hearing Room of the Office of Commissioner of Insurance, Ninth Floor, West Tower, Floyd Building, Two Martin Luther King, Jr. Drive, Atlanta, Georgia 30334.     

Oral presentations at the hearing may be limited to five (5) minutes per person in order to afford all interested persons an opportunity to be heard. Based upon full consideration of all written and oral comments regarding the above matters, the Commissioner of Insurance may reject or adopt the proposed rules or may make changes to the proposed rules which may require another rulemaking hearing.
