Public Forum
Pursuant to 31 CFR 33.112(c) and 45 CFR 155.1312(c), notice is hereby given that the State of Georgia Office of Commissioner of Insurance and Safety Fire (OCI) will conduct its annual Public Forum to provide updates on the progress of Georgia’s Section 1332 State Innovation Waiver and accept comments from the public.
Background Summary
The Patient Protection and Affordable Care Act (ACA) authorized Section 1332 State Innovation Waivers to allow states to pursue innovative strategies to provide residents with access to quality, affordable health insurance. The U.S. Department of Health and Human Services (HHS) and U.S. Department of Treasury approved Georgia’s 1332 Waiver application on November 1, 2020. The State implemented a reinsurance program on January 1, 2022. The reinsurance program is authorized under the waiver for a total of five years, through December 31, 2026. On June 1, 2026, Georgia applied to extend the Section 1332 State Innovation Waiver for an additional five-year period. The extension application is currently under federal review. Information regarding the Section 1332 Waiver may be viewed at the CMS website.
OCI will hold its annual Public Forum to provide updates on the progress of the 1332 Waiver and accept public comments. The public is invited to join in-person or virtually.

1332 Waiver
Governor Brian P. Kemp signed Senate Bill 106, The Patients First Act, into law on March 27, 2019, amending Article 7 of Chapter 4 of Title 49 and Title 33 of the Official Code of Georgia. The Patients First Act authorizes the Governor to submit and implement one or more Section 1332 Waiver applications to the United States Department of Health and Human Services (HHS) and the Department of Treasury (Treasury) on or before December 31, 2021, to pursue innovative strategies for providing residents with access to high-quality, comprehensive, and affordable health insurance.
The goals of the reinsurance program are to stabilize the market by reducing premiums and to attract/retain carriers across the State. All Affordable Care Act (ACA) -compliant, non-grandfathered individual market plans that cover Georgia residents are eligible for reinsurance claims payments. This includes all Qualified Health Plans (QHPs), and major medical plans sold on and off the federal exchange or Georgia Access.
